A will sets out how assets are distributed at death and allows an individual to name guardians for minor children, appoint an executor, and provide instructions for settling an estate. Will-based planning is often appropriate where assets and family circumstances are more straightforward or where a trust is not necessary. While a will generally requires probate, it remains a foundational estate planning tool for many individuals and families.
Trust planning is used to create a clear framework for how assets are managed during life and distributed at death. A properly structured trust can help avoid probate, provide continuity in the event of incapacity, and offer greater flexibility over how and when assets pass to beneficiaries.
